NOTICE TO ATTENDEES

Persons attending any auction hosted by Auction by Texas Thangs (ABTT) also known as Auctioneer are herein notified that an Auction Site is a potentially dangerous place. Heavy equipment may be in operation and electric circuits may be live or cords placed across walkways. Power tools being tested plus exhaust fumes, flammable, noxious, corrosive and pressurized substances may be present. Every person at the Auction Site before, during and after the auction sale SHALL BE DEEMED TO BE THERE AT HIS OR HER OWN RISK with notice of the condition of the premises, the activities on the premises and the conduct of third parties and any registered bidder shall so advise his agents or employees. No persons shall have any claim against the Auctioneers, their agents, employees or principals for any injuries sustained, nor for damages to or loss of property, which may occur from any cause whatsoever.
Any announcements in regards to terms and conditions or additions or deletions made day of sale, prior to or during auction, supersede any and all other advertising and/ or announcements.

REGISTRATION and BIDDING

To participate in the bidding process, you must register at every auction. You must be 18 years of age or older to be eligible to bid. To become registered, you must present a photo ID (Drivers License Required) to the Auction Registration Clerk. ABTT reserves the right to bar issuing a bidders card. Please note that when you register to participate in our auctions you are in agreement to ABTT terms and conditions governing the auctions. Your bid is your contract and you are responsible for payment of all items purchased with your bidder number. Auctioneer reserves the right to reject any and all bids and/or to bid as agent on behalf of any absentee bidder and/or the Auctioneer as buyers. Reserves the right to withdraw from or add to auction any item before or during the sale. Reserves the right to resell any item not paid for in full on sale day. Buyer shall be responsible to the Auctioneer for any and all expenses of collection and resale and any damages that may arise from the resale. Auctioneer reserves the right to group, subdivide, sell lots times the money, or sell lots in bulk.

In the event of tie bids or dispute of such, bidding will be reopened at Auctioneers discretion between those buyers only. Designation of winning bidder by Auctioneer is final.

No selling or trading between buyers on or within the auction premises during or after the sale. All merchandise must be physically removed from the auction site prior to any sale of merchandise by the buyer.

TERMS OF SALE

All items are sold AS IS-WHERE IS with NO WARRANTIES OR GUARANTEES expressed or implied. Auctioneer or Seller shall assume no liability and will not be responsible for the correct description, authenticity, genuineness, or defect in any lot and makes no warranty in connection therewith. No allowance, discount, set aside, or refund shall be made on account of any incorrectness, error in cataloging, imperfection, defect, or damage. Any and all descriptions or representations are for identification purposes only and are not to be construed as authenticated or as a warranty of any type. It is the sole responsibility of the buyer to have inspected the merchandise thoroughly and to have satisfied themselves as to its condition, value, authenticity, origin, genuineness, usefulness, or description. Buyer shall base their bid accordingly upon their judgment solely. All sales are final. Auctioneer and/ or Seller assume no liability for errors or omissions.

All payments must be made by cash, personal or company check (All returned checks will incur a $40 service charge), VISA, MasterCard and Discover are accepted. State and City taxes will be applied to your total purchase unless you have a VALID Texas Resale Certificate on file. TAX, TITLE and LICENSE FEES plus a $50 DOCUMENT FEE will be collected, when applicable, on all titled equipment and vehicle purchases. All Titles will be mailed when the buyer's funds have cleared the bank, but not before five (5) business days after the auction sale day. No purchases may be removed until paid in full. Payment is required by the end of auction day. Auction by Texas Thangs, its agents and auctioneers make no guarantees or warranties expressed or implied of any kind. Every item is sold "AS IS, NO WARRANTY". The catalog listing, when provided, is only a guide; please inspect equipment and all other merchandise carefully. All paid in full purchases must be removed from the auction site following the end of the auction or a storage fee will apply. You must have a sales receipt to exit the auction premises with your purchases.
NO smoking allowed in auction facility, homes, or offices where auction is conducted.

NO personal firearms or concealed weapons allowed within auction facility or site.

PROXY BIDDING TERMS AND CONDITIONS

ABTT provides a service to customers who are unable to attend an auction but wish to purchase one or more items in a specific sale. This service, often referred to as "absentee bidding", is Bid by Proxy. When you place a Bid by Proxy, ABTT bids on your behalf up to the maximum amount specified by you. ALL proxy bids are held in strictest confidentiality.

The credit card and credit card information that you provide to register as a Proxy Bidder is used ONLY to verify your identity and to approve you as a Proxy Bidder. You must contact us at (325) 665-2761 to make a payment with your credit card or remit payment to ABTT, PO Box 1654, Abilene, Texas 79604. The bidding is started with your bid unless a higher proxy bid has been received from another bidder. Bidding will begin at 50% your bid and will be continue at the next increment being asked for by the auctioneer. As long as bids are coming from the crowd, we continue to bid on your behalf until either the bidding from the crowd has exceeded your maximum bid, or you are the successful high bidder.

If you are the successful bidder the balance owed must be paid within 24 hours. Your purchases will not be released until the balanced has been paid.

All proxy bidders will be contacted after the sale and advised of the selling price.

All proxy bids are governed by the Terms and Conditions outline on the confirmation page plus the General Terms and Conditions that apply to all our auctions.

ABTT can approve or deny bidders at our discretion. We reserve the right to accept or deny bidders for any reason. Prior to approval ABTT may contact you to determine your credit worthiness. If we approve your bid, then we will process your bid in accordance with our terms and conditions.

By placing a bid you are entering into a legally binding and enforceable contract. Please keep in mind that you are bidding against other Internet and local Proxy bidders as well as floor bidders, (this list does not constitute a complete list of bidder types but does highlight the common bidder channels).

In consideration of your use of ABTT Proxy Bid Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by our registration form (such information being the "Bidder Information") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or ABTT has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, ABTT has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

ABTT reserves the right to change or amend these policies and procedures as needed, at any time and also the right to interpret these policies and procedures and to decide all issues of dispute concerning the same, which decision shall be final and binding.

All information obtained by ABTT is held in the strictest of confidence. We will not share or sell any personal or company information to a third-party.

This Auctioneer is licensed and regulated by the Texas Department of Licensing and Regulation and is covered by the Recovery Fund which is administered by the T.D.L.R.
